Melognite: Legal Notice & Consumer Information

A. Provider identification (§ 5 DDG)

B. Nature of the service

Melognite is a deterministic, music-theory-based tool for musical sketches with MIDI export and, on the Pro plan, a WAV Studio Recording of the live mix. It is not a generative AI model and makes no promise as to originality or exploitability (see ToS 2 & 5).

C. Reseller / Merchant of Record

Paid subscriptions are sold and invoiced by our authorised reseller and Merchant of Record, FastSpring (the FastSpring contracting entity named at checkout and on your receipt), which collects payment, issues receipts and invoices, and applies applicable VAT/sales tax. We remain the provider of the service.

D. Essential consumer information (distance contracts; Art. 246a EGBGB)

Main characteristics: access to the Melognite App to generate deterministic musical sketches and export MIDI and, on Pro, record the live mix as WAV, in the selected tier (Basic / Standard / Pro). Requirements: current browser with JavaScript & Web-Audio; internet connection.
Total price / term: the applicable monthly or annual price incl. taxes is shown at checkout by the MoR; subscriptions continue automatically until cancelled (details under Term & cancellation).
Payment: via the MoR using the methods it offers.
Term & cancellation: monthly or annual term, as selected at checkout; after the initial term the subscription continues for an indefinite period and can then be cancelled at any time with effect from the end of the current billing month (annual plans: unused full months are refunded pro rata); cancellable via your account menu (Plan → Manage subscription), the permanent cancellation page on this site, or the subscription management linked from your FastSpring receipt; a cancellation button per § 312k BGB is provided for online continuing paid contracts.

Legal warranty: statutory rights for defects apply.
Functionality/compatibility/interoperability: deterministic generation; Standard MIDI File export compatible with common DAWs; MIDI exports contain note data only; a Studio Recording (Pro) contains the played sounds, all Public Domain, CC0, released by its author for any use without restriction, or our own work; no copy protection beyond account/tier gating.

E. Right of withdrawal (consumers) + model form

Right of withdrawal. You have the right to withdraw from this contract within 14 days without giving reasons. The period is 14 days from conclusion of the contract. To exercise it, use our permanent Cancel contract page (the electronic cancellation and withdrawal function, linked in the footer of every page); you receive confirmation on a durable medium without undue delay. A clear statement by email to hello@melognite.app is equally effective. You may use the model form below. Sending the notice before the deadline suffices. Consequences: we/the MoR reimburse all payments received without undue delay and within 14 days. Early expiry (digital services): Melognite subscriptions are digital services. If you expressly request that performance begins during the withdrawal period, you owe a proportionate amount for the period until withdrawal (§ 357a BGB); the right of withdrawal itself expires only once the service has been fully performed and you had expressly consented and acknowledged this consequence (§ 356 BGB). One-off digital-content downloads (where offered) can expire earlier under the statutory digital-content rule after the same express consent and acknowledgement. F. EU online dispute resolution

The former EU online dispute resolution (ODR) platform was discontinued by the European Commission on 20 July 2025; no ODR platform link is therefore provided. We are not obliged and not willing to participate in dispute-resolution proceedings before a consumer arbitration board (§ 36 VSBG).

G. Third-party components and instrument credits

The Service uses third-party software and audio samples. The complete list of software components, instrument samples, drum kits, fonts and their licences, including the mandatory CC-BY and GPL attributions, is maintained on our dedicated Licenses page. Playback samples are in-browser preview only; customer MIDI exports contain no instrument or drum samples; on the Pro plan a download may additionally contain the specifically licensed transition-FX sound files (Licences §7, Terms 4.3). You may not extract or reuse these samples outside the Service (ToS 5.4).
